CHQ News- Cadre restructuring of Inspector Posts cadre.

All Circle Secretaries and CHQ office bearers are once again requested to see the note published on 21st June 2013 and 29th June 2013 regarding cadre restructuring of Inspector Posts cadre. It was already mentioned in the said notes that Directorate may call our Association for detailed discussion on this vital issue, as our sister unions / associations have already put pressure and requested Directorate to finalize cadre restructuring issues for their cadres.
Members are aware that the cadre restructuring issue was already discussed in several AICs and CWC meetings and it was decided that each circle will convey their views to CHQ. As on date only Tamil Nadu, Kerala and Odisha circles have submitted their views to CHQ.


All Circle Secretaries and office bearers are once again requested to convey their views / suggestions / draft note if any on the issue to General Secretary / President on their web address at the earliest.

CHQ News - Letter to Secretary (Posts) i/c/w non payment of RPLI incentives to Sub Divisional Heads.

Subject : Non payment of RPLI incentives to Sub Divisional Heads.

Respected Madam,

PLI Directorate vide letter No. 26-2/2009-LI dated 16-01-2013 has issued clarification about admissibility of incentive to SDI/ASP for verification/scrutiny of RPLI proposals clarifying that neither the Directorate letter no 26-02/2009-LI dated 18.9.2009 nor any other subsequent letter has been superseded by any of Directorate letter. Unfortunately despite clear and repeated instructions most of the postal divisions in the country are not still paying incentive equal to 10% of the procurement commission paid to the Gramin Dak Sewaks and Gramin Dak BPM’s whose proposals are verified by such SDI/ASP. As such these orders are found not implemented in true spirit.

Furthermore, the PLI/RPLI work has long back been decentralized to the Divisions except Surrender and Death claims. This has increased enormous work pressure on the Divisional Office, particularly, the IPs and ASPs working in the Divisional Office. At present Inspectorial Staff are burdened with variety of duties in addition to what has been enumerated in Chapter-III of Postal Manual Volume-VIII. The honorarium paid to the Inspectorial Staff attending to the scrutiny of new proposals is Rs. 2/- per proposal subject to ceiling of Rs. 4000/- p.a. The ceiling of Rs. 4000/- p. a. honorarium was fixed by the Department of Personnel & Training which includes, the honorarium paid for conducting departmental inquiries as IO or PO and also other allied additional works.

The quantum of honorarium paid for scrutiny of PLI/RPLI proposals is no commensurate with the quantum of work performed and the ceiling on honorarium is a major setback for the Inspectorial Staff working in Divisional Offices. The Association requests your kind honour to replace the existing system of payment of honorarium for this work without a ceiling limit of Rs. 4000/- and Inspectorial Staff may be remunerated at the same rate not as honorarium but as incentive that do not have any limitations. Also call for reports from Circles why incentive equal to 10% of the procurement commissions as required in Directorate letter No. 26-2/2009-LI dated 16-1-2013 of the procurement commission paid to the GDS whose proposals are verified by SDI (P)/ASP is not being paid despite clear instructions on the issue.

OA No. 289/13 filed by CHQ adjourned to 8/8/2013 before the Registers Court. The brief of reply filed by DOP is as under:
None of the grounds raised by the applicant is tenable in the eyes of law or on facts. It is respectfully submitted at the risk of repetition that in compliance with the directions of this Hon’ble Tribunal contained in Annexure A-19 order, the issue was taken up with the Nodal Ministry, Department of Expenditure to have a re-look at the level of Secretary. The matter was examined in the Nodal Ministry and it was not agreed for the up gradation of the Grade Pay of the Inspector (Posts) on par with that of the Inspectors of Income Tax CBDT and CBCE citing the following reasons:

(a) Inspector Posts were in the Pay Scale of Rs.5500-9000 prior to 6th CPC. However, the 6th CPC in para 7.6.14 recommended, inter-alia,”……. The Commission is recommending the merger of pre-revised pay scale of Rs.5500-9000 and Rs.6500-10500 which will automatically bring Inspector Posts on par with Assistants in CSS/Inspector and analogous posts in CBDT/CBEC…..”. Therefore, Inspector Posts have eventually come at par with Assistant CSS/Inspector CBDT/CBEC consequent on merger of pre-revised pay scalee of Rs. 5000-8000, 5500-9000 and 6500-10500. As such, there was no specific recommendation in para 7.6.4 to the effect that Inspector Posts are granted pre-revised pay scale of Rs. 6500-10500. Therefore, Inspector Posts have been granted normal replacement as per Part A of CCS(RP) Rules, 2008 and are rightly placed in the scale of Rs. 9300-34800 in PB-2 with Grade Pay of Rs. 4200/-. It is submitted that initially, as per recommendations of the 6th CPC in para 3.1.14, Inspector of CBDT/CBEC were also placed in the scale of Rs. 9300- 34800 in PB-2 with Grade Pay of RS. 4200/-. Subsequently, by virtue of being in the pre-revised pay scale of Rs. 6500-10500 as on 01-01-2006, they have been covered by Annexure A-8 OM dated 13-11-2009 and were placed in the pay of Rs. 9300-34800 with Grade Pay OF Rs. 4600/- corresponding scale of Rs. 7450-11500/-.
(b) Inspectors in CBEC/CBDT were placed in the scale of Rs. 6500-10500 with effect from 21-04-2004 ie, prior to 6th CPC by an executive order of the Government keeping in view their parity with Inspectors of CBI/IB and directions of the Hon’ble CAT, Jabalpur Bench. Further, Assistants of CCS have also been granted the pay scale of Rs. 6500-10500 with effect from 15-09-2006 onthe basis of their traditional parity with Inspectors CBEC/CBDT.  
(c) Subsequently, Assistants of CCS were placed in the scale of Rs. 9300-34800 with Grade Pay of RS. 4600/- corresponding scale of Rs. 7450-11500/- vide Annexure A-10 OM dated 16-11-2009. The Grade Pay of RS. 4600/- has been extended to only four Head Quarter services ie, Central Secretariat Service (CSS), Armed Forces Headquarters Service (AFHQ), Indian Foreign Service‘B” IFS (B) & Railway Board Secretariat Service (RBSS) and their counterpart Stenographer Services. Therefore, it was a conscious decision of the Government to keep Assistants in CSS/Inspector and analogous posts in CBDT/CBEC in the higher pre-revised scale ie, Rs. 7450-11500/- considering their pre-revising relativities, hierarchical structure, mode of recruitment etc. The mode of recruitment was not the only criteria as contended by the applicants in the OA. In various cases, the Apex Court also opined that wholesale identity between two groups would involve matters relating to nature of work, educational qualification, mode of appointment, experience etc.

(d) It is pertinent to mention here that the Annexure A-8 & A-10 OMs came into existence as a result of demand from various quarters of Government seeking up gradation for pre-revised scale of RS. 6500-10500 due to functional requirement. However, hierarchical structure of Inspector Posts does not demand such functional requirement, as post of ASP in the scale of pay of Rs. 9300-34800 wityh Grade Pay of Rs. 4600 in PB-2 corresponding to pre-revised scale of Rs. 7450-11500 still exists, even after implementation of 6thCPC recommendations.

(e) That the 6th CPC vide para 7.6.14 considered the demand for the scale of Rs. 6500-10500 at par with Inspector CBDT/CBEC and Assistants of CCS. Since Inspector Posts have come in the Pay Scale of Rs. 9300-34800 with Grade Pay of Rs. 4200/- in PB-2, corresponding to pre-revised scale of Rs. 6500-10500, the hierarchical posts in their cadre ie, ASP and SP had to be placed in the Grade Pay of Rs. 4600/- and Rs. 4800/- respectively to maintain the relativity in the cadre. Moreover, the scale of other similarly placed posts ie, Assistant Manager and Manager in Mail Motor Service were also placed in the Grade Pay of Rs. 4600/- and Rs. 4800/- respectively. In case the demand of Inspectors Posts for the Grade Pay of Rs. 4600/- is accepted, it will have cascading effect involving huge financial implications. Also, the demand for up gradation from similarly placed posts in Mail Motor Service etc will arise immediately.

(f) The duties and responsibilities of Inspector, CBDT/CBEC relates to enquiry and survey, assessment, tax evasion, petitions, prosecutions, TDS, tax recovery, prosecution before Tribunals/Courts, investigations etc. The Assistants of CSS performs the duties relating to parliament matters/cabinet matters, service matters, formulation/review/monitoring of national policy/programs on various subjects, assistance to executives, legislatures in the smooth functioning of the Government etc. Therefore, the duties and responsibilities assigned to the Assistants CSS and Inspector, CBDT/CBEC are quite different from that of Inspector (Posts). There is no comparison between Assistants CSS& Inspector CBEC/CBDT and Inspector (Posts). They are performing different duties in their respective cadres.

It is submitted that the issue was examined by the Secretary (Finance) and the proposal for up gradation of the Grade Pay of the Inspector (Posts) on par with that of the Inspectors of Income Tax CBDT and CBCE was rejected by the Nodal Ministry citing the above mentioned reasons. The decision of the Ministry of Finance was communicated under the signature of the Under Secretary and the same was communicated to the applicants by the office of the 3rd respondent. 
Under the above circumstances, it is humbly prayed that the Applicants’ prayers in the Original Application are devoid of any merit and the Applicants are not entitled to get any of the reliefs sought for in the Original Application and the Original Application is liable to be dismissed with cost to the Respondents.

TIME FOR ANALYTICAL ASSESSMENT -- WHAT'S WRONG, WHERE WRONG

Kudos and congrats to Sh. Vilas Ingale, GS IPASP Association for his achievements while heading the Association and giving a yeomen’s service. Initially it was being murmured if we are giving weak GS to the Association but this proved wrong. Members of the association should not tweet merely for personal interest and their decision should not be based on what others think. Just because others are doing something does not mean it shall also be the best choice for them. Our GS is a man of caliber so listen to his guts. By writing a letter on repatriation he has done a remarkable job. Asking for regular JTS DPC is not the prerogative of IPASP Association when Group B officers have their separate association and their GS is sitting in Directorate. It is his duty to watch the interest of PS Group B officers. IPASP GS has correctly said that a large number of JTS/STS posts are lying vacant and PS Group B officers are officiating without any benefit. Working on ad-hoc arrangement is not in the interest of employee when their service is not to be reckoned for regular promotion. It is well settled principle that promotion, including ad-hoc promotions, is to be given only on prospective effect. Hence, no ad-hoc promotion is to be given retrospective date. Besides, no weightage for the purpose of seniority/promotion/MACP is to be given for the service rendered by the employee on ad-hoc basis. (OM no. 28036/1/20001-Estt dated 23.07.2001 refer). Moreover, in many circles like Punjab, Haryana, Gujarat etc even ad-hoc arrangements are not resorted to being non availability of eligible Group B officers, rather combined charge of two divisions is given to manage the work. Why group B officers association is not taking case with Secretary Post for regular and timely JTS DPC for 2012 and 2013 by calculating correct vacancies so that no imbalance is caused in Group B and ASP cadre and every one may get timely promotion? IPASP Association correctly gave its views to delegate powers to Circle to downgrade Group A post to Group B temporarily till eligible Group B officers are not made available for ad-hoc arrangement. Else officers association should ask for regular Class-I DPC so that no resultant vacancy may arise and ad-hoc arrangement is only made in the event of retirement etc only. What an irony! We ought not to demand pay parity, No matter if we are forbidden from regular DPC/Supplementary DPC, increment for higher responsibility etc is not our right. Neither should we ask for repatriation nor for anything else may be legitimate. For what we have the right to ask and do --- I think to do work what our superior wants and act as a puppet for them because there is no dearth of PAPPUS in the cadre (Read EK THA PAPPU)
Please think of the ASPs who are sitting in other Circle at the fag end of their service without getting benefit of single pie. This may not be applicable to young officers coming through LDCE because they may dreaming of GP of 7600/- but some veterans are retiring in GP of 4800/- without even getting one higher responsibility increment. Otherwise these old officers are more dexterous in their job owing to their experience than the young lucky new incumbents. The main reasons for the refusal to promotion in response to AD comments are:
  • No increment of higher responsibility is allowed despite having clear instructions to fix pay on promotion to the post carrying higher duties and responsibility even if carrying the same grade pay. This is not being done
  • Non-grant of GP of Rs. 5400/-after four years of working in the GP of Rs. 4800/-(MACP). In this case functional scale of regular Group B is taken into consideration that promotees cannot complete owing to defective policy of department due to non-convening of timely DPC. Here double standard is adopted. On one side, department is considering GP of Rs. 4800/- granted under MACP as final grant on regular promotion and on the other side they are considering only promotional date for grant of Non-functional GP of Rs.5400. Is it not injustice being double standard?
  • Before elevation to Group B 99% ASPs (except those come through LDCE) are placed in the GP of Rs.4800/- which they get by virtue of length of service and on promotion higher responsibilities are forced without extra remunerations. Why should we own such responsibility when pay is not to be fixed in view of schedule III. I am referring this because prior to 1986 when scale of LSG and IPO was same the pay of LSG official on promotion to IPO was fixed under FR-22C. Why nobody is fighting on same analogy.
  • My request to all the readers and effected persons is to make representations to Department for fixing seniority for all purposes notionally or otherwise from the date of grant of GP of Rs.4800/- and place senior to all those who received GP of Rs.4800/-thereafter.
  • In the Group B list issued by directorate promoting ASPs to PS Group B, fixation of some officers has been done under FR22 (I) a (1) though their fixation is after receiving three promotions/ financial upgradation whereas this rule has not been applied to other similar situated persons despite the fact that they are receiving same promotion and equal number as others. This is illegal, arbitrary and against the principal of natural justice. If the Department does not come for the amicable solution, legal recourse is the only remedy left with the comrades.
